NCAA spokesperson Stacey Osburn said the Infractions Appeals Committee does not have the power to increase existing penalties or levy new ones against Florida State. If the appeals committee reversed the vacation-of-victories penalty, it could not, for instance, cut more scholarships.

While this has been my position all along, I do acknowledge some others here who have said that the NCAA "reserves the right to do so."

While anything is possible, this does make me feel a little more comfortable, but I am still anxious to put this miserable PR nightmare to bed once and for all. However, let us remember the NCAA can and will do whatever they feel like doing, because they think of themselves as invincible.

Wouldn't it be just our luck.
Now, Osburn did say that the Infractions Appeals Committee could give the case back to the Committee on Infractions for further review, in which case the Committee on Infractions could adjust the penalties. But Osburn made clear that such instances are extremely, extremely rare.

I really think we will lose this appeal and see no further stuff.

reverse and remand....

that is the potential problem….if the case got kicked back down, the process and punishment could start all over again, with directions that explicit facts be put into the record.

FSU’s argument is that the decision was not properly supported with record evidence, so it makes sense that on appeal (whether or not there is a prohibition against it) that the Appeals Committee wouldn’t be the body handing out a different punishment. I think that is consistent with what most of us thought was the situation.

No WAY the NCAA grants FSU a win on this appeal without further punishments.

This writers claim that there is some standard process that prevents it? When did that EVER matter to the NCAA. They constantly change how they inforce rules and punish.

Andrew Carter has rocks for brains if he buys that. NCAA = inconsistant, power hungry, crooks. He is naive at best to believe that.

NCAA completely changed the rules for FSU with the footlocker scandal.

Carter is a sharp dude who does a great job covering the Noles.

He’s just reporting what his source inside the NCAA told him. He said it is “very rare” which based on what I could find, is true. Very Rare doesn’t mean impossible.

If we start attacking solid reporters like Carter, who will we be left with?

I, for one, am glad he filed this report because it will make it more difficult for the NCAA to do something half-cocked.

I understand the lack of respect for the NCAA and the MSM, but let’s leave “rocks for brains” for the other more juvenille FSU message boards.

People don’t want to cover the ‘Noles because our media relations department treats reporters like garbage, denies them access, and FSU isn’t a good program right now (compared to UF). Carter doesn’t suck up to tge Gators.

that FSU has a bad media policy (thanks TK and Spetman).

Still I think Carter is garbage. Didn’t like his handling of the McDaniel MLB thing and I think he is arrogant to close the books here like he knows there will be no further punishment. Ticked me off that it lead to many ‘nole’ fans knocking our best recruit and some calling him a ‘liar’.

The NCAA contradicts itself all the time, lies, is inconsistant, etc, etc. Don’t tell me ‘in conlusion, it is unlikely’. Nothing is unlikely with the NCAA unless you just fell off a turnip truck.

Do you prefer someone who doesn’t cover it from both sides, gets everyone all rialed up about nothing and tries to sell subscriptions off of it, while their users dig into our #1 recruit with thousands of comments.

He was the only one to get both sides of the story, and cover it truthfully as a reporter.

but is is a joke.

The kid was actually drafted. That wasn’t made up. I don’t care if it was $800K (actually a figure his coach confirmed he saw on a cell phone text) or $50K. A very poor kid from Madison is going to think a minute.

This was all internet petty BS jealously that I don’t get. We are all Nole fans. Was it worth taking cheap shots at our most loyal, most talented recruited to take cheap shots at another website? Not to me. Lame.

Now I don’t know what to think, and I may need to be reprogrammed. Meanwhile, speaking of Jacobbi, I heard he reported to camp without Lee Gordon’s credibility. Not sure if it was ever in his possession or if he’s the second person to lose it this year. (Jacobbi, they did you wrong, man.)

As I pointed out earlier

a former Nole football player and FSU law school grad is chairman of the IAC. While he won’t decide the case, I doubt the committee will act in an arbitrary and capricious manner this time.

we were the ONLY program slapped with probation for “lack of institutional control” due to an agent giving away gifts without the coaches’ knoweldge. UF? WISC? nada.

But, that was 15 years ago. We have a Nole on the key committee now.

No one would disagree with that.

But you went hard after a credible journalist with a track record of treating FSU fairly at an outlet that generally does not. Then you reference, out of the context of the discussion, journalists who are neither credible nor fair to the part of the Florida State fanbase that places honesty and integrity in reporting over the protection of a figurehead and his cronies and the procurement of a subscription base that has yet to figure out it’s involved in a scam. Finally, you went off on this site with words like “internet petty BS jealously,” which simply make you look silly and totally disconnected with what we do here. If TN wanted to compete with WC, you’d have been banned before I had the chance to comment. I thought your points about the NCAA were plenty valid, by the way. Not sure why you went postal, but everyone here will forgive you. I’m on at least my ninth life. Another thing WC can’t compete with.

Personally, I'd like to see fewer refugees from

“The Territory” and such sites where that portion of the fanbase you describe dominates. Obviously, FSU does not need another BB-cheerleading, “remember when” site. Fans like that are largely responsible for empowering the boosters and adminstration to create the mess we’re in (although such fans with a cricital reasoning deficit like to hide behind phrases like “loyalty” and “bandwagon” and “media conspiracy” and “the NCAA’s out to get us”) We just don’t need more of that nonsense here.

noles55, one of the things that make this such a great country is that we are all entitled and allowed to have opinions and express them freely.

You seem to be believe, and you seem to have firm and strong opinions regarding Carter, how the McDaniels draft and offer was reported and handled by everyone concerned, and how the NCAA will ultimately punish FSU further. It is your right to have and to express these opinions.

My opinion is that you are dead wrong on your perception of AC, that you have the McDaniels chain of events totally confused, and my opinion on the outcome of the appeal is that it will be either won or lost, without any further sanctions. It would be very arrogant of me to think I could make you change you opinions, and it would be a waste of both of our time in attempting to do so. Therefore this keyboard heave is not intended to try to convince you of anything, just to speak my mind regarding your comments.

For the record, Carter is the only one I am aware of, including every news organization and every pay site, that has been able to get a comment and quote from anyone inside the NCAA, and even more impressively on the record. This spokesperson was quoted as stating that the IAC does not have the power…..etc……
Who are you, Carter, or myself, to say this is incorrect or wrong, when it came directly from a NCAA spokespersons mouth?

Furthermore Carter included another quote stating

Carter was the first to contact and speak directly to McDaniel after the draft and only reported what McDaniel told him. Carter was also the first to actually talk to a Brewers rep regarding the offer and only reported what the rep told him.

Carter is one of only 3 or 4 beat reporters LEFT covering the Noles, and this is not due to FSU’s idiotic media access rules and policies, but because of the decline of the print media, because of the economy, and because of the availability of information on the web.

I do agree with your opinion that the Slantinel is a butt kissing Gator-run fish wrapper. However I have been reading the Chopping Block almost since day one and I have never read Carter writing any pro or anti Gator comments, unlike the other hacks such as Bianchi and co., who are obsessed and are involved in a love fest with everything Gator, Meyer, and Tebow.

As a matter of fact, recently Slantinel jerk off David Whitley had the nads to write how lucky FSU fans are that their POS rag is still even covering the Noles at all. This was really a great PR decision and a good way for them to increase the readership numbers of a company that is presently in bankruptcy.

I also agree with you, as I stated above, that the NCAA can and will do anything they please, however I can’t see any further action happening after this PR nightmare is finally over.

So, as has already been said here, we are all Noles, nothing personal, but at the same time I felt I had to have my say and make my points.

Orlando Sentinel

I like AC. I think he tries to be fair and balanced and I give him credit for doing what he does with the limited resources that the Sentinel gives him.

David Whitley I think is gone from the Sentinel. I don’t see his name on their website and haven’t seen a article from him in ages. I got into it pretty good when he wrote his last hack job of FSU but haven’t heard from him since.

I do think the Sentinel is slanted toward the Gators, but that’s because they are frontrunners, just like the rest of MSM. They are only going to offer content they believe will drive readership. Unfortunately they don’t believe covering FSU in an in depth fashion does that. Our loss in OTown. I’ve been lobbying hard to change that and I hope they listen. All you have to do is ride around Orlando and see that we are split 50/50 in our love of FSU or UF. Unfortunately they aren’t covering it that way now. As an example see Bianchi’s last hack job.

Looking forward to the appeals ending and settling in on a new year of FSU Football.
